Not sure this is legal

Ive disabled my GPS and do not allow location services for anything, somehow this app manages to still record my location whenever I use it.

Im almost positive Apple should remove this from the App Store as its against the policy to let an app access something when you have disabled all ways for the app to access it. What else is this app accessing without my permission.
